Hello All,
I am stuck in a very painful scenario right now. I am working on F1-OPT which ends on Feb 5th 2011 and have a pending H1-B application under premium processing. The thing is my employer says that they will terminate me on Feb 4th and cannot guarantee a rehiring even if H1-B is approved.
My employer needs to know if there is something (legal) like temporary termination and rehiring ? If yes then what does the employer need to do to rehire. And is there any documentation about this. My employer wants to check this documentation before reconsidering.
Any inputs would be appreciated.

Hi,
My family had visited me way back in 2004 on a visitor visa. Due to unavoidable circumstances, they had to stay beyond the stipulated 6 months ( for 2 more months). We had requested the govt. for extension approval and it had been granted then.
We would like to have them visit us again by Nov of this year. However, when they went for the visa to consulate(last week), it got rejected, because the consulate person informed them that they had overstayed last time around.
I would like to know when can I legally apply for the visa again? And is there a way I could enhance my chances of an approval, rather than a rejection, next time I try. I am working on an EAD and my husband had filed for I485 for our family(I140 approved stage).
Any advise would be appreciated.

My problem is
I am on valid L1 with company A and company B has applied for H1 for me. If my H1 gets approved
1. Can I continue to work on L1 with company A.
2. I want to go back to home country on vacation. If my H1 is approved can I go back to my home country and come back on L1?Do I need to get my L1 stamped again to enter back in US on L1? what will happen to my H1?
Please Advice.

It is better to wait to switch after your I-140 approval ....
If you switch before, your employer could cancel the application or might not answer RFE if one is issued ...
If you are sure that employer will be very cooperative, then you can easily shift now ...

1. EB3 PD-April 2003 System Analyst/Programmer Analyst Degree:B.E.
2. EB2 PD-May 2000 Project Manager/Senior Architect/Team Lead Degree: Masters in CS prior to 2K
American co., no need to pay for labor. Should come with a project with a corp to corp option. Co. has clients but it may take time as July 16th is last date.

My I-140 got approved and priority date from EB3 got ported to EB2. I read in one of the forum threads that USCIS system would automatically identify that application is current and appropriate action will be taken. Also, I read about initiating interfile process of existing EB2 I-140 (current) with Pending I-485 application (under EB3). I am not sure whether I should wait few weeks before initiating interfile process.
I have given my biometrics in 2007 while filing I-485. Will USCIS send appointment for Biometrics again ?

One of my friend's I-485 with priority date of Jan 2006 got approved yesterday. They have posted the documents to USCIS for his wife early this month(as per his attorney) to link to his I-485, but the check was not cashed yet and receipt notice was not issued for his wife.
Will there be any issue in this regard? What will be the options for him just in case if the attorney has not sent the documents to USCIS for his wife or the documents get rejected for some reason? Any help/advice in this regard is really appreciated. Thanks.

Here is my situation wrt to I 140 and EAD.
1. I am on 6th year of H1 this year and my H1 expires on 30 Sept 2010. I have to apply for H1 extn this year.
2. My employer started GC process (EB3) in 2006 on substitute labor of Aug 2005. He applied I 140 in April 2007.
3. He applied EAD when they are current during June, July 2007 based on substitute labor. I and my wife got EAD eventhough my I 140 is pending.
4. As old I 140 is pending he applied another I 140 with different EB3 labor for me in 2008 and both new labor and I 140 got apporved. He ported my A# of EAD card to this new I 140 showing as beneficiay on it.
5. My old I 140 is still pending and USCIS didnt send any query on that till date. My employer is confident on getting approval of old I 140.
Here are the questions I have:
Can I work on EAD by taking full time jobs by applying AC 21? Does it safe to work on EAD?
If my old I 140 gets any problem what are consequences with my GC process?
Can anybody answer, Please.
