Hi,
My H1visa expirs on Aug 2009.I am travelling to india this month and be back at the end of May09.I have EAD and AP in my hand and valid till next year.
After I come back I want to change my employer using EAD in the month of July09.
1.While return back which one I have to show at POE? H1 or EAD?
2.If I show H1 I will get I94 card only till Aug09.So later If Ichange to EAD will it be problem?
3.If I show AP at the POE, my status legally changes to Parole.So can I continue till Jun09 with my current employer on H1? Because I don't want to change to EAD with my current employer as I am getting offer in July09 from new employer.
4.I am planning to add my spouse to my GC status after I come back.He is on H1B right now.What are the impacts if I migrate to EAD?
Can you please respond back immediately.Thanks a lot.

I got this mail today saying the pledge failed to meet its target of 100 people. Only 88 signed up for the pledge :mad:
I think we need to start another drive as we have more members now and we are very close to the lame duck session. Any suggestions???

Hi,
My I-485 case was approved on 7/23, got approval letter on 7/30.
In August I got the Code 3 Biometrics letter and now I got it for Code 2. Two Biometrics appointment within a month!
Does this usually happen? No CPO e-mails or card yet!

Hello All,
As per the latest regulations, the employer has to pay for all the labor application cost. My employer has agreed to do my green card, but are little hesitant to pay the cost (due to budget constraint). What legal options/adjustments can I make with my employer so that the cost process is not delayed? Thanks in advance.

Dear All,
I followed the instructions and clicked where indicated and the programme ran and produced �I�m all GUI inside�. However, instead of the neat rounded corners, I only saw square corners.
I am trying to design my programmes using rounded corners, which is why I read the tutorial and downloaded Expression Blend 4.

Hi,
I have entered in US with a H1B of company A. I got it transferred to company B in Nov 2008 and got it approved .. i have I797 and I94 valid till Dec 2010.
In May 2009 I have initiated H1b transfer with company C and today I came to know that it is denied. I dont know the reasons yet.
Can any one suggest what are my available options.
Can I initiate transfer with another company with the 1797 of the companyB

I filed my I-485 and I-140 together in July 2007 using substitute labor (priority date) in Eb3 category.
I have Master degree, so can I change my category from EB3 to EB2 and keep the same priority date?

On May 1, 2006, hundreds of thousands of immigrants around the country demonstrated against a restrictive immigration bill introduced in Congress. This weekend, similar demonstrations will occur around the US. I'll be attending my 20th law school reunion in Chicago this weekend and am hoping to attend that rally. I'd really rather be at the one in Phoenix and look forward to hearing reports from there.

what type of cases, you meant ?
I can't help but notice that about 1/4 of recently processed audit cases were denied. As it goes now, I'll have to wait about another 6 month for a 75% chance to pass. Well for where the economy is headed right now it all probably won't matter anymore in 6 months.

Hi ,
1.My wife works for part ime H1b. She has her H1B till Aug 2011. She would Like to apply for her GC. Can she apply for labor certification with part time job? She can get a full time job after she gets in to adjustment of status. She doesn't want full time job now as our kids are still small.
2.I have a fulltime H1B and Approved I-140 EB2. PD sept 2007, waiting for retrogression to file 485!!!! god know when that will happen.Can I apply for EB1 while my EB2 pending?
I have good credential to meet EB1.

I just came back from India with my H1 visa expired and my wife had a valid H4 visa until May. At the port of entry, Immigration officer told me that since she is on my dependent visa, she had to enter on AP also. so both of us used AP though she had a valid visa

� We travelled out of US on 10-Dec-2009 and only gave the L2 I-94 on departure, didn�t give H1 I-94
� She got her L2 stamped from India and entered US on L2 on 03-Jan-2010
Please let us know the following:
� Is there any potential of her H1 getting cancelled because she entered back on L2?
� Do we need to get her H1 stamped immediately by going to Mexico?
� Is her L2 EAD still valid and can she work?
